Regulations for the carriage of passengers and luggage
§1. Definitions
- The Regulations for the carriage of passengers and luggage in force at the Ryba Taxi taxi company (hereinafter referred to as the Regulations) – this set of rules applicable in taxis:
- owned or used by T&R Sławomir Rybacki, with its registered office at ul. Krzemieniecka 51a, 54-402 Wrocław, holding tax identification number (NIP) 894-242-46-78, REGON: 020120094 (hereinafter referred to as RYBA TAXI), operated by drivers employed by RYBA TAXI under an employment contract or carrying out the carriage of passengers and luggage in the name and on behalf of RYBA TAXI.
- owned or used by drivers and business partners conducting their own business activity in the field of passenger transport, cooperating with RYBA TAXI.
- Customer – a natural person, legal entity or organizational unit without legal personality using standard or special services.
- Passenger – any natural person, legal entity or organizational unit without legal personality present in the vehicle during the provision of the service, excluding the driver.
- Immediate booking – a service offered by RYBA TAXI or the drivers referred to in §1 para. 1 point b) of the Regulations, consisting of transporting the Customer and their luggage from the pickup point to the location indicated to the Driver by the Customer. The standard service does not include stops at the Customer's request.
- Scheduled booking – a service performed on a date and time specified by the Customer.
- Shopping – a special service consisting of the Customer ordering the purchase of specified goods, carried out at the nearest available shop or petrol station, excluding large-format retail outlets.
- Price list – the price list set out in the Regulations containing information for Customers regarding the applicable remuneration for services.
- Passenger area – the area in the taxi covering the interior of the taxi and all seats, intended solely for the carriage of persons, allowing the carriage of hand luggage only where this does not affect driving safety.
- Luggage area – the area in the taxi covering the entire luggage compartment space, excluding items used for vehicle repair, intended solely for the carriage of hand luggage, which includes in particular: suitcases, backpacks and travel bags which, both by their size and manner of packaging, will not cause damage to or soiling of the vehicle.
- Mini move – a booking placed by the Customer for taxi transport using the passenger area for luggage purposes.
- Additional service – services offered by RYBA TAXI or the drivers referred to in §1 para. 1 point b. of the Regulations, other than the standard services described in these Regulations, offered by RYBA TAXI or the drivers referred to in §1 para. 1 point b. of the Regulations, including transport performed using special vehicles at the Customer's request. For ordering a special service, the Customer is obliged to pay flat-rate additional charges (in addition to the charges specified in §3 of the Regulations), set out in the price list (§4 of the Regulations)
- Special vehicle – a passenger taxi of the VAN or BUS type
§2. Ordering services by the Customer
- The Customer may order the transport service offered by RYBA TAXI in one of the following ways:
- by telephone at 713 067 067 by contacting the RYBA TAXI dispatcher
- via the website www.rybataxi.pl
- through the mobile application
- When placing an order, the Customer is obliged to provide at least:
- the start and end location of the ride,
- the planned start time of the ride (in the case of a scheduled booking),
- the number of passengers and any remarks concerning luggage or special needs (e.g. transport of animals, mini move, airport transfer).
- After accepting the order, the dispatcher provides the Customer with the estimated arrival time of the taxi. The indicated time is approximate and may change depending on the conditions of city traffic. For a scheduled booking, RYBA TAXI reserves the possibility of a delay of up to 10 minutes.
- The driver waits for the Customer free of charge for up to 7 minutes from the moment of arrival at the indicated address. After this time is exceeded, a waiting charge is applied in accordance with the current RYBA TAXI price list. If there is no contact with the Customer after 7 minutes, the driver has the right to end the wait, and the ride is deemed not cancelled by the Customer, which results in a charge being applied in accordance with §6 of the Regulations.
- In situations where the Customer is picked up from a closed or private area (e.g. a housing estate), the Customer is obliged to provide the driver with the possibility of entering the premises or to indicate another available pickup location nearby.
- RYBA TAXI is not liable for delays in the performance of the ride resulting from independent factors, such as traffic jams, road accidents, unfavourable weather conditions, roadworks or other transport difficulties.
- Orders requiring additional activities (e.g. shopping on request, transport of animals, vehicle return, mini move) are treated as special services and are subject to separate pricing in accordance with the RYBA TAXI Special Services Price List.
- RYBA TAXI reserves the right to refuse to accept or perform an order in the following cases:
- no vehicles available at a given moment,
- no safe possibility of reaching the pickup location,
- a request to perform a ride contrary to the law or safety rules,
- the Customer's previously unsettled debts towards the company
- An order is deemed effectively placed at the moment of its confirmation by the driver or dispatcher, and the commencement of the ride means the Customer's acceptance of the anticipated conditions of the journey.
§3. Transport service price list
- Transport services provided by RYBA TAXI are performed in accordance with the current Transport Services Price List, available on the website www.rybataxi.pl.
- All prices are given in Polish zloty (PLN) and include the applicable VAT.
- The minimum cost of a ride within the city of Wrocław is:
- PLN 20 for passenger vehicles
- PLN 30 for VAN vehicles
These amounts already include the initial charge, including the first 4 kilometres of the ride.
- After exceeding a distance of 4 kilometres, a rate of PLN 2.50 applies for each subsequent kilometre started for a passenger vehicle and PLN 3.50 for each kilometre started for a VAN vehicle.
- Rides performed outside the boundaries of the city of Wrocław are settled according to flat rates, set individually before the start of the journey.
- During holiday periods, New Year's Eve and New Year, special rates for rides may apply. We inform about any changes to the price list on these days when placing the order.
- The Customer has the right to obtain information about the applicable rates before the start of the ride – by telephone or directly from the driver.
§4. Additional services price list
- Additional services provided by RYBA TAXI are performed in accordance with the current Additional Services Price List, available on the website www.rybataxi.pl.
- The price list specifies the amount of charges for services not directly related to the carriage of persons, in particular:
- shopping on request,
- transport of animals,
- delivery of parcels,
- jump-starting a vehicle using cables or a booster,
- wheel replacement,
- vehicle return,
- luggage assistance or mini moves,
- Christmas tree transport „Rybka Christmas Tree”
- rides performed by a woman „Lady Rybka”
- other special services provided at the Customer's request.
- All prices for additional services are given in Polish zloty (PLN) and include the applicable VAT.
- The amount of the charge for a given service is determined on the basis of the price list in force at the time of its order. For atypical services or those requiring additional activities, the price may be set individually with the driver or dispatcher.
- The Customer has the right to obtain information about the current charges before placing an order by telephone.
§5. Payment terms
- The Customer is obliged to settle the amount due for the performed transport service or additional service immediately after the end of the ride, in accordance with the current Price List available on the website www.rybataxi.pl.
- Payment for a ride may be made in one of the following forms:
- in cash directly to the driver
- by payment card using a payment terminal,
- via the BLIK mobile payment system
- with a RYBA TAXI cashless voucher
- The Customer has the right to obtain a VAT invoice for the performed service. For this purpose, they are obliged to provide the invoice details to the email address: faktury@rybataxi.pl or send them via the contact form on the website www.rybataxi.pl within 7 days of the performance of the service.
- In the event of a payment terminal failure or technical problems with electronic payment, the Customer is obliged to settle the amount due in cash.
- The driver has the right to refuse to start the ride or to continue the journey if the Customer refuses to make the payment or attempts to avoid settling the amount due for the previous ride.
§6. Ride cancellation and order cancellation rules
- The Customer has the right to cancel an ordered ride without incurring costs, provided they do so before the driver arrives at the indicated address.
- In the event that the driver reaches the pickup location and the Customer:
- does not appear at the agreed location within 7 minutes of the driver's arrival, or
- cancels the ride after the vehicle's arrival,
the ride is deemed cancelled after time and may be charged a fee in accordance with the current Ryba Taxi Price List.
- The driver waits for the Customer free of charge for up to 7 minutes from the moment of arrival at the indicated address. After this time is exceeded, a waiting charge is applied in accordance with the Price List. If there is no contact with the Customer after 7 minutes, the ride may be deemed not performed due to the Customer's fault.
- The Customer incurs a charge for a non-performed immediate ride if the driver:
- established effective telephone contact with the Customer,
- provided them with the estimated arrival time,
- the Customer accepted this time and nevertheless did not appear at the agreed location or resigned after the driver's arrival.
- The Customer incurs a charge for a non-performed scheduled ride if they did not cancel the order at least 15 minutes before the agreed performance time. Cancellation after this time results in a charge being applied in accordance with the current Ryba Taxi Price List.
- In the case of flat-rate rides (outside the boundaries of the city of Wrocław), cancellation must take place at least 30 minutes before the planned ride performance time, or, in the case of more distant localities, with notice corresponding to the driver's travel time to the pickup location. Cancellation after this time results in a charge being applied in accordance with the Ryba Taxi Price List.
- In the case of orders placed via the mobile application, a charge for a non-performed ride may be applied on the basis of the mere fact of the Customer's acceptance of the ride, without the need for additional telephone contact. By placing an order through the application, the Customer has the possibility of real-time preview of the vehicle's location and the anticipated arrival time, which constitutes effective confirmation of the order.
- In a situation where the Customer duplicates a ride by placing the same order through different channels (e.g. by telephone and through the application) – the order is deemed cancelled due to the Customer's fault. In such a situation, the Customer is obliged to cover the penalty fee, in accordance with the current Ryba Taxi Price List.
- In disputed situations concerning ride cancellation or the application of a cancellation fee, the Customer has the right to submit a complaint to the email address: reklamacje@rybataxi.pl, in accordance with the rules set out in §7 of these Regulations.
§7. Responsibility of the Customer and the driver
- The RYBA TAXI driver is obliged to perform services in a safe manner, in accordance with road traffic regulations and with respect for the rules of personal culture towards the Customer.
- The Customer is obliged to behave in the vehicle in a manner that does not endanger driving safety, the cleanliness of the car or the comfort of the driver and other passengers.
- The Customer is liable for any damage to or soiling of the vehicle, arising through their fault or as a result of the actions of accompanying persons. In the event that damage or soiling of the interior is found, the driver has the right to apply a cleaning charge or compensation in accordance with the current RYBA TAXI Price List or on the basis of the actual costs of cleaning and repairing the vehicle.
- Smoking tobacco, consuming alcohol and intoxicants, and consuming meals that may cause soiling or a lasting smell are completely prohibited in the vehicle. The driver has the right to refuse to perform or continue the ride in the event of non-compliance with these rules.
- The driver may refuse to transport a Customer who:
- is clearly under the influence of alcohol or intoxicants,
- behaves aggressively or in a manner that endangers safety,
- refuses to pay for the previous ride or raises reasonable suspicion as to their intention to pay it,
- attempts to transport dangerous objects or materials.
- The Customer bears full responsibility for the transported luggage, personal belongings and animals. The driver is not liable for the loss or damage of items left in the vehicle after the end of the ride.
- In the event of leaving items in the vehicle, the Customer may contact the driver or the RYBA TAXI dispatcher in order to recover them. The company does not guarantee the return of items that were not reported immediately after the end of the ride.
- The transport of domestic animals is permissible only with the driver's consent, in a manner ensuring the safety and cleanliness of the vehicle. The animal should be secured (e.g. in a carrier, on a leash or with a muzzle, if required).
- The driver is obliged to exercise due diligence during the provision of services, in particular with regard to the safe carriage of passengers, the protection of their property and personal culture.
- Any disputes, remarks or claims concerning the performance of the ride, the driver's behaviour, liability or charges collected may be reported in the form of a complaint. Complaints should be directed to the email address: reklamacje@rybataxi.pl. The report should contain the Customer's first and last name, the date of the ride, the time, the start or end location and a brief description of the event.
§8. Monitoring and safety in vehicles
- To ensure the safety of passengers, drivers and the protection of property, RYBA TAXI vehicles may be equipped with a video and audio monitoring system.
- The monitoring covers the interior of the vehicle, including the passenger and driver space. The recordings are not used for purposes other than:
- ensuring the safety of passengers and drivers,
- preventing conflict situations and acts of vandalism,
- documenting the course of events in the case of complaints, claims or road incidents,
- fulfilling obligations arising from legal regulations.
- The controller of the monitoring data is RYBA TAXI. Personal data in the form of the image, voice or behaviour of the Customer are processed on the basis of the legitimate interest of the controller (Article 6(1)(f) GDPR), consisting in ensuring safety and the protection of property.
- Monitoring recordings are stored for a period of up to 30 days from the date of their registration, unless they are necessary for evidentiary purposes in ongoing proceedings — in which case they may be stored until those proceedings are concluded.
- Access to the recordings is held solely by authorised RYBA TAXI personnel and, if necessary, the relevant law enforcement authorities, on the basis of legal regulations. The recordings are not transferred to other entities, are not made publicly available and are not used for marketing purposes.
- The Customer has the right to obtain information about the processing of their personal data, including monitoring data, in accordance with the rules set out in the RYBA TAXI Privacy Policy, available on the website www.rybataxi.pl.
- Travelling in a vehicle covered by monitoring constitutes acceptance of these rules and consent to the processing of personal data within the scope specified in this paragraph.
- Vehicles covered by monitoring are marked with appropriate information in a visible place inside the passenger cabin.
§9. Final provisions
- These Regulations set out the rules for using the passenger transport services and additional services provided by RYBA TAXI. Placing a ride order, using the journey or accepting an order in the mobile application is tantamount to acceptance of the provisions of these Regulations.
- RYBA TAXI reserves the right to introduce changes to the Regulations, including updating the Price List, the rules for providing services or the scope of the offer. All changes come into force at the moment of their publication on the website www.rybataxi.pl.
- In matters not regulated by these Regulations, the provisions of the Civil Code and other generally applicable laws of the Republic of Poland apply.
- Any disputes arising from the performance of services will be resolved primarily amicably, and in the absence of agreement — by the competent common court in accordance with applicable regulations.
- The Customer has the right to submit a complaint or grievance concerning the quality of services, the driver's work or the charges applied. Complaints should be directed to the email address: reklamacje@rybataxi.pl. The report should contain data enabling identification of the ride (date, time, start and end location of the journey) and a brief description of the event.
- RYBA TAXI stipulates that the Regulations and information published on the website www.rybataxi.pl are of an informational nature and do not constitute a commercial offer within the meaning of the provisions of the Civil Code.
- These Regulations come into force on the date of their publication on the website www.rybataxi.pl and remain in force until a new version is introduced.
